Affiliates Program

Earn commission dollars with eLights.com, the premier online resource for home, commercial and industrial lighting. There's no charge to participate. In fact, we pay you! Every time a customer you refer buys from our site, you earn a percentage of the sale. It's that easy!

The tools we provide through our Yahoo Store server make it easy to start earning commission dollars. When your visitors follow those links and buy from us, we'll pay you 10% of the sale. Yahoo Store reports let you track every sale, every day. Since Yahoo Store is a neutral party and the commission reports are generated by an automatic program on their server, you can be assured of their accuracy.

If you are interested in participating in the eLights Affiliates Program and earning commissions, please read and complete the following information. It is a valid legal agreement and necessary for us to be able to provide you commissions.
 
This agreement describes the entire terms and conditions for participation in the eLights.com, Inc. Affiliates Program. In this agreement, the term "Participant" refers to you (the applicant), and "sponsoring Web site" refers to the Web site from which you will link to www.elights.com. Wherever the agreement refers to "you" or "your", it means "the Participant"; "we" or "our" refer to eLights.com, Inc.
 
Links to eLights.com, Inc.: You will provide links to the eLights.com, Inc. site home page or to any specific products you wish to sell. There is no limit to the number of links to eLights.com, Inc. that you may develop as part of this service. You may add or remove the links at any time and without prior written approval from eLights.com, Inc.
 
Referral Fee Amount: The referral fee amount is calculated on the total products purchase price sold during any calendar month. Only those products sold by eLights.com, Inc., shipped to a customer, and for which eLights.com, Inc. has received full payment will qualify for a referral fee. Referral fees will not be paid on shipping, handling, and sales tax charges.
 
Referral Fee Percentage: Affiliates will earn 10% of the selling price for all eLights.com, Inc. products sold under this program.
 
Referral Fee Payment: eLights.com, Inc. will send a referral fee check for the applicable referral fee (less any taxes required to be withheld under applicable law) and a statement of customer purchase activity to the Participant approximately 20 days after the end of each calendar month.
 
Referral Fee Calculation: Products sold by eLights.com, Inc. that are purchased by users entering directly from an eLights.com, Inc. link at your website will qualify you to earn referral fees. Customers must link from your website to the eLights.com, Inc. website, add product(s) to their shopping basket, and submit that order by using the eLights.com, Inc. purchasing system. All products purchased by the customer during their visit from your site will earn commission. 
 
Returns and Cancellations: If a referral fee eLights.com, Inc. product purchased under this program is later returned by the customer, its referral fee will be deducted from the next payment sent to the Participant. The returned product referral fee will be deducted from the next payment.
 
Order Processing: eLights.com, Inc. will be solely responsible for processing every order placed by a customer following the link(s), provided under the program, from your sponsoring Web site. Customers will use the eLights.com, Inc. online ordering process. Order forms, payment processing, shipping, cancellations, returns, and related customer service are the responsibility of eLights.com, Inc. 
 
All of the rules, operating procedures and policies of eLights.com, Inc. regarding customer orders and accounts will apply to orders we receive through special links on your sponsoring Web site. eLights.com, Inc. reserves the right to reject any order that does not comply with our rules, operating procedures and policies.
 
Tracking & Implementation: eLights.com, Inc., and Yahoo Store will be solely responsible for tracking referral sales from your Web site.  The Yahoo Store online reports let you track every sale. Since Yahoo Store is a neutral party the numbers provided can be trusted. When your visitors follow those links and buy from us, we'll pay you 10% of the sale. You will be solely responsible for ensuring that the link(s) are formatted properly to include your Affiliate number. eLights.com, Inc. will provide you with a unique link code to use to link to eLights.com and a URL to track sales made from the participating web site.
 
Copyrighted material: As the Participant, you are solely responsible for ensuring that information related to a product obeys all applicable copyright and other applicable laws. You must have express written permission to use another party's copyrighted material. eLights.com, Inc. will not be responsible if you use another party's copyrighted material in violation of the law. 
 
eLights.com, Inc. customer policy applies to all orders: Every customer who buys products through this program is deemed to be a customer of eLights.com, Inc. eLights.com, Inc. is not responsible for any representations made by you, the Participant, which contradict our policies. All eLights.com, Inc. policies regarding customer orders, including product availability, pricing and problem resolution, will apply to these customers. To protect eLights.com, Inc. customer privacy, the names or other personal information about specific customers will not be provided to the Participant.
 
Product prices and availability: The price charged for every product sold will be determined by eLights.com, Inc. You may not specify product prices in your sponsoring web site that are different than listed by eLights.com, Inc. Product availability and pricing changes frequently and eLights.com, Inc. will present the best information available and cannot guarantee the availability or price of any product.
 
Acknowledging eLights.com, Inc. on the sponsoring Web site: eLights.com, Inc. reserves all rights to its trademark via graphic images or banners provided to Affiliates Program Participants.
 
Sites Not Qualified for the eLights.com, Inc. Associates Program include: Sites that promote sexually explicit material, violence; discrimination based on race, sex, religion, national origin, physical disability, sexual orientation or age; and Sites that promote illegal activities.
 
Restrictions on personal use: This program is intended to be used by visitors to your sponsoring Web site and not by you or members of your organization. Participants who use this program to purchase items for their own use are in violation of the agreement. eLights.com, Inc. may, in its sole discretion, terminate this agreement and/or withhold payment of referral fees if we find that this has occurred. 
 
Web Site service interruption: eLights.com, Inc. will make every effort to keep its Web site operational. However, certain technical difficulties may, from time to time, result in temporary service interruptions. eLights.com, Inc. shall not be liable for any of the consequences of such interruptions.
 
Term of the Agreement: The Participant may receive referral fee payments on qualifying orders that are placed during the term of this agreement. This term will begin on the date that your application is approved by eLights.com, Inc., and shall end when canceled by either party as provided below.
 
Referral Fees earned through the date of expiration or cancellation of this agreement will remain payable only if the eLights.com, Inc. products are not returned or canceled from their orders. Payment of the final referral fee payment to the Participant may be withheld for a reasonable time in order to ensure that the correct amount is paid. 
 
The agreement may be modified: eLights.com, Inc. reserves the right to change any of the terms and conditions in this agreement, at any time and in its sole discretion, by posting a new agreement on our Web site. All provisions of this agreement are subject to change without notice other than posting such information on our Web site.
 
Cancellation of this agreement: Either eLights.com, Inc. or the Participant, acting in their sole discretion, may choose to cancel this agreement at any time by written notice of cancellation to the other.
 
Warranty Disclaimer: eLights.com, Inc. makes no warranties, representations or conditions with regard to the program or, except as expressly set forth in eLights.com, Inc.'s then current sales policies, any products sold thereunder, whether express or implied, arising by law or otherwise, including without limitation any implied warranty of merchantability or fitness for a particular purpose or non-infringement or any implied warranty arising out of course of performance, course of dealing or usage of trade.
 
Limitation of Damages: ELIGHTS.COM, INC. SHALL HAVE NO LIABILITY FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES OR ANY LOSS OF REVENUE OR PROFITS ARISING UNDER OR WITH RESPECT TO THIS AGREEMENT OR THE PROGRAM, EVEN IF ELIGHTS.COM, INC. HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES of such. Further, eLights.com, Inc.'s aggregate liability arising under or with respect to this agreement or the program shall in no event exceed the total referral fees paid or payable by eLights.com, Inc. to the Participant under this agreement.
 
Miscellaneous: Participant and eLights.com, Inc. are independent contractors and nothing in this agreement is intended to or will create any form of partnership, joint venture, agency, franchise, sales representative or employment relationship between the parties. Participant shall not assign this Agreement, by operation of law or otherwise, without the prior written consent of eLights.com, Inc. Subject to the foregoing restriction, this agreement is binding upon, insures to the benefit of and is enforceable by the parties and their respective successors and assigns.
 
Governing Law: This agreement shall be governed by the laws of the State of New York without reference to its choice of law principles.
